Statement from Ian P. Moloney, Chief Policy Officer of the American Fintech Council (AFC), on the American Lending Fairness Act of 2026

“AFC strongly supports the American Lending Fairness Act of 2026 and commends Representative Davidson for his leadership in advancing this critical bipartisan legislation. We are pleased that the bill has been included in the House Financial Services Committee’s markup and urge members of the Committee to support it. DIDMCA has enabled state-chartered banks to compete on equal terms with national banks and serve customers across state lines under a consistent, uniform federal framework. Recent attempts by states to opt out of these protections harm a fundamental quality of the U.S. banking system and threaten to create an uneven playing field that will reduce competition, limit credit availability, and increase costs for consumers and small businesses.”

“As the largest trade association representing responsible fintech lenders and innovative banks, we have led the charge in states across the country to educate policymakers on the consumer harm caused by opting out of DIDMCA. We have supported both lawsuits that seek to combat the misguided state DIDMCA opt-outs and are eager to see federal clarity that finally protects consumers' access to responsible financial services, regardless of which financial institution is offering them.”
