Statement from Phil Goldfeder, Chief Executive Officer, American Fintech Council on Tenth Circuit's Decision to Grant En Banc Hearing in Challenge to Colorado DIDMCA Opt-Out Law

“We welcome the Tenth Circuit’s decision to grant rehearing en banc and vacate the prior ruling in the challenge to Colorado’s DIDMCA opt-out law. The decision underscores the seriousness of the legal questions at stake and affirms that this case deserves full consideration of the Circuit court.

“Colorado’s attempt to opt out of the federal framework established under DIDMCA threatens to create a fragmented, state-by-state system limiting access to safe, affordable credit and undermining the ability of community banks and responsible fintechs to serve consumers.

“Today’s decision is an important step toward restoring clarity, consistency, and fairness in our national credit markets. We appreciate the Tenth Circuit’s careful consideration of this case and remain confident that a full review will reaffirm Congress’s intent to establish a uniform framework that protects consumers, supports competition, and enables responsible innovation.”
